Company AML and KYC Policy

This AML (Anti-Money Laundering, hereinafter referred to as the Policy) regulates the activities of Cometa.gg regarding the fight against money laundering and its involvement in the fight against money laundering and the financing of terrorist activities.

If a connection is found between transactions and the aforementioned platforms, the administration of the exchange service has the right to request that the identity verification procedure (KYC) be completed. This procedure includes providing a video selfie with a passport clearly showing the passport series and number, full name, as well as demonstrating the wallet or account from which the transaction was sent, with readable data on the date, time, amount, and recipient address.

After successfully completing full verification, the exchange may be suspended, and the funds returned to the sender's address minus the transfer commission incurred. If, during the sending of funds, the exchange service's exchange accounts are blocked due to risk control, the service reserves the right to issue a refund after unblocking the client's assets on the exchange account.

The Service strives to comply with all laws and regulations on combating money laundering and terrorist financing, and therefore decides to block or reject transactions that meet the criteria for risky activity. The goal of Cometa.gg is to ensure the safety of all service users and prevent possible financial crimes.Definitions of Terms

1.1. Cometa Service (Service) — a system for providing internet services for the exchange, sale, and purchase of electronic assets and electronic money.

1.2. Service website — Cometa.gg.

1.3. User — any individual using the services of the Cometa Service and having accepted the terms of the privacy policy, as well as the Cookies policy of the Cometa Service.

1.4. Digital Currency — cryptocurrencies and any other currencies based on the blockchain.

1.5. Electronic Currency — funds held in the accounts of users of electronic payment systems.

1.6. Fiat Money — money not backed by gold or other precious metals, whose nominal value is established and guaranteed by the state regardless of the cost of the material used for its manufacture.

1.7. Card Verification — a check of the card's (or account's) ownership by its owner, performed once for each new User card. The terms of the check are established by the Service.

1.8. Money Laundering — actions aimed at returning money or other securities of illegal origin to the financial and economic market, presenting their acquisition and possession as completely legal and normal, as well as carrying out other illegal operations. In accordance with international legislation, Cometa.gg adheres to a number of rules and implements a number of procedures aimed at preventing the use of the Service for money laundering operations. Our anti-money laundering policy is aimed at increasing the safety of clients and the services provided by the Service.

1.9. Terrorist Financing — the willful provision or collection by any means, directly or indirectly, of funds with the intention that they be used for terrorist acts.Measures Taken in Compliance with the AML Policy

The management of the Cometa.gg service, understanding the public danger of crimes related to money laundering and the financing of terrorist activities, has developed a set of organizational and legal measures to comply with the provisions of national legislation, as well as the requirements of the intergovernmental organization FATF.

2.1. Application of the KYC (know your customer) policy. Mandatory identification of Users performing exchange operations on our Service. For User verification, the Administration has the right to request the following data:

  • Take a photograph ("selfie") with the citizen's identity document: a scan copy of the front and back sides of an official identity document with a photograph, i.e., a valid passport, driver's license, or other national identity document.
  • Confirm place of residence: an official document issued within the last 3 months, clearly indicating the client's name and address specified during registration on the Cometa.gg website. This can be a utility bill (for water, electricity, or landline phone) or a bank statement. The copy must include: full name, full residential address, date of issue (within the last 3 months), the name of the authority that issued the document, with an official logo or seal.
  • Provide a copy of the front and back sides of the bank card and/or a photograph of your bank card taken against the background of the Service's main page. To ensure confidentiality and security, only the last 4 digits of your card should be visible. It is permitted to hide the CVV code (3 digits on the back of the card).

The administration of the Cometa.gg service will take steps to confirm the authenticity of the documents and information provided by the Users. Identification information will also be verified using secondary sources, and the Service Administration reserves the right to continue investigating cases to gain full confidence in the authenticity of the provided documentation.

The administration of the Cometa.gg service reserves the right to monitor User data on an ongoing basis, especially in cases where their identification information has been changed or their activity seemed suspicious (unusual for a specific User). Furthermore, the Administration reserves the right to request up-to-date documents from Users, even if they have been verified as authentic in the past.

2.2. Continuous monitoring of operations passing through the Service. We carry out continuous control over all applications created on the Cometa.gg website. The Service Administration notifies Users of the prohibition on conducting exchange operations from third parties using their account.

2.3. Improving the professional skills and knowledge of the Cometa.gg team employees regarding compliance with the Policy requirements.

2.4. Interaction with government bodies in cases established by law. In the event of an official request from law enforcement or judicial bodies, we will be obliged to provide them with the requested information. The Service Administration also has the right to provide data requested by official representatives of payment systems.

2.5. Improving the security of the Cometa.gg service software. We care about the reliability and security of transactions carried out on our service. In this regard, we are constantly improving our IT department, whose main task is to protect the website from unauthorized access by intruders.

2.6. The administration of the Cometa.gg service, in cases prescribed by law, may issue a regulatory requirement to verify the source of fiat money and/or cryptocurrency to ensure that the sources of Funds that the Client uses for exchange are legal. A bank statement for fiat money or a video demonstrating the transaction details of the wallet for cryptocurrencies can serve as a document confirming the source of the Funds.

In accordance with this Policy, the Service Administration will:

  • Monitor all transactions. The Administration reserves the right to ensure the transmission of suspicious transaction reports to the appropriate law enforcement authorities through the Responsible Officer.
  • Request any additional information and documents from the User in case of suspicious transactions, also at the request of the regulator (the regulator may be an exchange, a government institution, or another organization with relevant legal grounds).
  • Suspend or terminate the User's account if there is a reasonable suspicion that such a User is involved in illegal activity.

"Know Your Transaction," or KYT, is a phrase used in the financial sector to describe the process of assessing cryptocurrency transactions for fraudulent or suspicious activity, such as money laundering. KYT is a component of the anti-money laundering policy and helps assess transaction risks and identify transactions associated with financial crimes, such as money laundering and terrorist financing.

The KYT Policy is aimed at identifying a client's transaction in the event of a precedent where the Service has reasonable suspicion that the client is trying to use the service and its services to carry out illegal transactions or launder funds.

Such a precedent may arise if the Service suspects the Client of illegal activities that may be classified as money laundering or an attempt to launder digital assets obtained unlawfully, or if the funds have an overtly criminal origin. For these purposes, the Service has the right to use any legal information, third-party means of analyzing the origin of digital assets, as well as its own screening system developments.

In this case, the Cometa.gg Service reserves the full right to:

  • Require the Client to provide additional information disclosing the origin of digital assets and/or confirmation that these assets were not obtained through criminal means.
  • Block the account and any operations related to the Client, transfer all available information and documents related to the incident to the financial control and/or law enforcement agencies at the place of registration of the Service and, if necessary, at the address of the Client's registration.
  • Require the Client to provide documents confirming identity, physical existence, registration address, and solvency.
  • Return digital assets only to the details from which the transfer was made, or switch to other details after a full verification by the Service security service, if the legal origin of the Client's funds has been verified.
  • Refuse the Client the withdrawal of funds to third parties' accounts without explanation.
  • Withhold the Client's funds until a full investigation of the incident is completed.
  • Monitor the entire transaction chain to detect suspicious transactions.
  • Refuse the Client the provision of the service if the Service has reasonable suspicions about the legality of the origin of digital assets, and withhold funds in special Service accounts.
  • Refuse the Client the provision of the service if the Service has reasonable suspicions about the legality of the origin of digital assets and withhold funds in special Service accounts in case it is impossible to trace the entire chain of movement of digital assets from the moment of their appearance.

Terms of Refund for Funds Halted for Verification following an AML Transaction Analysis:

  • Funds are returned after a full check by the Service security service, which may include detailed verification of the sender. Funds are returned minus a commission of up to 5% of the transaction amount, but no more than 100 USD to cover the labor costs for processing the application and organizing the return of funds.
  • The refund, subject to approval by the Service, will be processed by the Service within 7 (seven) calendar days, starting from the date the User was notified of the Service's decision regarding their refund request.
  • When processing a refund after passing the verification procedure, the User is obligated to confirm the details for receiving the returned funds.
